Terms of Service

These terms govern your use of kellumroofing.com and describe the general terms under which Kellum Roofing LLC provides roofing services. Specific work is governed by the written contract for that project, which controls if it conflicts with anything here.

Note: This document is substantive and industry specific rather than a placeholder stub. Jeremy should have an Arizona attorney review it before it goes live, particularly the warranty, limitation of liability and insurance claim sections.

About Us

Kellum Roofing LLC is a roofing contractor based in Glendale, Arizona, holding Arizona Registrar of Contractors license number 352782. We are bonded and insured and serve the greater Phoenix metropolitan area.

Use of This Website

Content on this site is provided for general information about our services. Roofing conditions vary by property, and nothing on this site constitutes an inspection, a diagnosis of your specific roof, a quote, or a binding offer. Do not rely on general guidance here in place of having your roof evaluated.

You may not use this site to transmit unlawful, abusive or fraudulent content, attempt to gain unauthorized access to it, or use automated systems to scrape or overload it.

Estimates and Proposals

Free inspections and written estimates carry no obligation. Estimates are based on conditions observable at the time of inspection and remain valid for the period stated on the proposal. Material pricing can change, and estimates may be revised if not accepted within that period.

An estimate becomes binding only when both parties execute a written contract.

Concealed Conditions

Roofing work regularly uncovers conditions that could not be observed before the existing roof was opened, most commonly damaged or deteriorated roof sheathing, framing damage, prior repairs performed improperly, or moisture within an existing system. Where practical, proposals include an allowance or a unit price for such work.

Any work beyond the contracted scope requires your authorization before we proceed, and will be documented in a written change order stating the additional scope and cost.

Scheduling and Weather

Roofing is weather dependent. Monsoon activity, high wind, extreme heat and rain can require pausing work for the safety of our crews and the integrity of the installation. We will keep you informed of schedule changes. Delays caused by weather, permitting authorities, material availability or matters outside our reasonable control do not constitute a breach of contract.

Permits and Association Approvals

We obtain the permits required by the governing municipality for the contracted work. Where a homeowners association or architectural committee has jurisdiction over roofing materials or appearance, obtaining that approval is the property owner's responsibility unless the contract expressly assigns it to us. We will supply product information needed for a submittal.

Payment

Payment terms, including any deposit and the schedule for progress and final payment, are stated in the written contract for your project. Past due balances may accrue interest as permitted by Arizona law. We may suspend work on an account that is materially past due.

Financing offered through third party providers is a contract between you and that lender, not with us. Their terms, rates and approval decisions are theirs.

Warranties

Two distinct warranties may apply to your project.

Manufacturer warranties cover roofing materials and are issued by the manufacturer, not by Kellum Roofing. Their duration, coverage and exclusions are set by the manufacturer, and registration or maintenance requirements may apply. We provide the manufacturer documentation for the products installed.

Workmanship warranty covers our installation and is stated in your written contract, including its duration and what it does and does not cover.

Neither warranty covers damage from causes outside our work, including storm, wind, hail, fire, seismic events, falling objects, impact, foot traffic by others, work performed by other trades including solar and HVAC installation, structural movement or settlement, alterations or repairs by others, failure to perform reasonable maintenance, or pre existing conditions we identified in writing and were not authorized to correct.

Workmanship warranty coverage is contingent on payment in full.

Insurance Claims

Where roof damage may be covered by property insurance, we can document conditions with photographs and provide a written scope of repair. The coverage determination belongs entirely to your insurance carrier.

We are roofers, not public adjusters or attorneys, and we do not negotiate claims on your behalf, advise you on your policy, or act as your representative with your carrier. Arizona law restricts who may adjust insurance claims for compensation. Any agreement between you and your insurer is separate from your contract with us, and you remain responsible for payment under that contract regardless of what your carrier ultimately pays.

We do not offer to waive, absorb, or rebate any insurance deductible.

Property Access and Site Conditions

Providing safe access to the work areas is your responsibility, including securing pets, moving vehicles, and clearing items from work zones and from attic or garage areas beneath the roof where vibration may dislodge stored items.

Roofing generates vibration and debris. We take reasonable precautions including daily cleanup and magnetic sweeps for fasteners, but we recommend removing or securing fragile items from walls and shelving, and covering stored belongings in the garage and attic before work begins.

Limitation of Liability

To the fullest extent permitted by Arizona law, our liability arising from services or from this website is limited to the amount paid for the work in question, and we are not liable for indirect, incidental, consequential or punitive damages, including loss of use, loss of income or diminution of property value.

Nothing here limits any right you have under Arizona's contractor licensing statutes, including recourse through the Arizona Registrar of Contractors and, where applicable, the Residential Contractors Recovery Fund.

Dispute Resolution and Governing Law

These terms and any contract for services are governed by the laws of the State of Arizona. Venue for any dispute is Maricopa County, Arizona.

Before initiating a formal proceeding, contact us at (480) 258-0925 so we can attempt to resolve the matter directly. Most issues are resolvable that way. Complaints regarding licensed Arizona contractors may also be filed with the Arizona Registrar of Contractors.
